These Terms of Service ("Terms") govern your access to and use of the website located at https://ssdiapprovalassist.com (the "Site") and any forms, content, and services made available through the Site (collectively, the "Service"). The Site and Service are operated by US Funding Direct ("we," "us," or "our").

By accessing the Site, submitting any form on the Site, or otherwise using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Site.

IMPORTANT. SECTION 14 OF THESE TERMS CONTAINS A BINDING INDIVIDUAL ARBITRATION AGREEMENT AND A CLASS-ACTION WAIVER. EXCEPT FOR THE LIMITED OPT-OUT RIGHT IN SECTION 14(e), YOU AND WE AGREE TO RESOLVE DISPUTES THROUGH INDIVIDUAL ARBITRATION RATHER THAN IN COURT, AND TO WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION. PLEASE READ SECTION 14 CAREFULLY.


1. What the Service Is — and Is Not

We operate the Site as a consumer lead generation service. We collect contact information from consumers who request more information about Social Security Disability Insurance ("SSDI"), Supplemental Security Income ("SSI"), or related benefits, and we transmit that information to one or more third-party marketing partners, attorneys, advocacy organizations, non-attorney representatives, or other lead buyers (collectively, "Partners"). We are paid by Partners for those leads.

We do not retain, use, sell, or share the personal information you submit for any purpose other than (a) transmitting it to Partners and (b) maintaining the consent, routing, and recordkeeping data required by applicable law, including the Telephone Consumer Protection Act ("TCPA"). We do not provide SSDI, SSI, legal, medical, advocacy, or claims-handling services. Any such services are provided by the Partner that contacts you, and not by us.

We are not affiliated with, endorsed by, or sponsored by the Social Security Administration ("SSA") or any federal, state, or local government agency. You can apply for SSDI, SSI, or any other government benefit directly with the SSA, free of charge, at www.ssa.gov or by calling 1-800-772-1213.

Submitting information through the Site does not create an attorney-client relationship, does not constitute a request for legal advice, and does not guarantee that you will qualify for, be approved for, or receive any benefit. Eligibility for benefits is determined solely by the SSA. We do not represent or warrant the qualifications, services, fees, conduct, or results of any Partner.

2. Eligibility

You must be at least 18 years old and legally capable of entering into a binding contract under U.S. law to use the Site. The Site is intended only for residents of the United States. By using the Site, you represent and warrant that you meet these requirements.

3. Form Submissions; Accuracy of Information

When you submit a form on the Site, you provide certain personal information (such as your name, telephone number, email address, and mailing address) for transmission to Partners. By submitting a form, you represent that:

  • the information you provide is true, accurate, and current;
  • you are providing your own information, or you are legally authorized to provide it on behalf of the person to whom it relates; and
  • you are not providing information you obtained unlawfully or in violation of any third-party right.

We may, in our sole discretion, decline to transmit, or remove from our systems, any submission we believe is inaccurate, fraudulent, duplicative, or in violation of these Terms.

4. Consent to Be Contacted

By submitting a form on the Site, you provide your express written consent to be contacted by Partners by telephone (including calls placed using an automatic telephone dialing system, autodialer, artificial voice, or prerecorded voice), SMS/text message, email, and postal mail at the contact information you provided, even if those numbers appear on a federal, state, corporate, or internal Do Not Call list. Your consent is not a condition of any purchase. Message and data rates may apply, and message frequency may vary.

You may revoke consent with any Partner by following that Partner's opt-out instructions (for example, replying STOP to a text message, clicking "unsubscribe" in an email, or asking the Partner by phone to stop contacting you). Because we do not control any Partner after your information is transmitted, you must revoke consent with each Partner directly. 5. Acceptable Use

You agree not to use the Site to:

(a) submit information that is false, inaccurate, misleading, or that you do not have the right to submit;
(b) impersonate any person or entity, or falsely state or misrepresent your affiliation with any person or entity;
(c) violate any applicable law, regulation, or third-party right;
(d) transmit content that is unlawful, threatening, harassing, defamatory, obscene, or otherwise objectionable;
(e) transmit any virus, worm, trojan horse, or other malicious code;
(f) interfere with, disrupt, or impose an unreasonable load on the Site or its underlying infrastructure;
(g) access the Site or its data through any automated means (including bots, scrapers, crawlers, or harvesting tools) without our prior written consent;
(h) copy, modify, distribute, sell, lease, or create derivative works of any part of the Site;
(i) reverse-engineer or attempt to extract source code from any software underlying the Site; or
(j) use the Site for any commercial purpose other than as expressly permitted by us in writing.

We may, in our sole discretion and without notice, refuse, restrict, suspend, or terminate your access to the Site for any reason, including a suspected violation of these Terms.

6. Modifications to the Service and to These Terms

We may modify, suspend, or discontinue the Site or any part of the Service at any time, with or without notice, and we will not be liable to you or any third party for any such modification or discontinuation.

We may update these Terms from time to time. When we do, we will post the revised Terms on the Site with an updated "Last Updated" date. Material changes will be identified in a reasonable manner. Your continued use of the Site after changes are posted constitutes your acceptance of the revised Terms.

7. Intellectual Property

The Site and all content on it — including text, graphics, logos, images, code, and software (the "Site Content") — are owned by us or our licensors and are protected by U.S. and international intellectual property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Site Content for your personal, non-commercial use, subject to these Terms. All other rights are reserved.

"SSDI Approval Assist" and our logos are our trademarks. Other names, logos, and marks referenced on the Site are the property of their respective owners and are used for identification purposes only.

8. Third-Party Links and Partners

The Site may contain links to third-party websites and services, including those of Partners. We do not control, endorse, or assume responsibility for any third-party website, service, or content. Your use of any third-party website or service is at your own risk and is governed by that third party's own terms and privacy policy.

9. DMCA Notice and Takedown

If you believe that material on the Site infringes your copyright, please send a notice to our Designated Agent containing the information required by 17 U.S.C. § 512(c)(3):

  • a physical or electronic signature of the copyright owner or a person authorized to act on the owner's behalf;
  • identification of the copyrighted work claimed to be infringed;
  • identification of the material that is claimed to be infringing and a description of where it is located on the Site;
  • contact information for the complaining party, including a physical address, telephone number, and email address;
  • a statement that the complaining party has a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law; and
  • a statement, under penalty of perjury, that the information in the notice is accurate and that the complaining party is the copyright owner or is authorized to act on the owner's behalf.

10. Disclaimer of Warranties

THE SITE, THE SERVICE, AND ALL CONTENT AND MATERIALS MADE AVAILABLE THROUGH THEM ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, COMPLETENESS, AVAILABILITY, AND UNINTERRUPTED OPERATION. WE DO NOT WARRANT THAT THE SITE WILL BE ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

WE DO NOT ENDORSE, VOUCH FOR, OR WARRANT THE QUALIFICATIONS, SERVICES, FEES, CONDUCT, OR RESULTS OF ANY PARTNER. YOUR INTERACTIONS WITH PARTNERS ARE SOLELY BETWEEN YOU AND THE PARTNER.

Some jurisdictions do not allow the disclaimer of certain warranties, so some of the above disclaimers may not apply to you.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, US Funding Direct, ITS AFFILIATES, AND THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUES, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO (a) YOUR USE OF, OR INABILITY TO USE, THE SITE OR SERVICE; (b) ANY ACT, OMISSION, COMMUNICATION, OR SERVICE OF ANY PARTNER; (c) ANY DISPUTE BETWEEN YOU AND A PARTNER; OR (d) ANY UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR INFORMATION, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SITE OR SERVICE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100.00).

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

12. Indemnification

You agree to defend, indemnify, and hold harmless US Funding Direct, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your access to or use of the Site; (b) any form submission or content you provide; (c) your violation of these Terms; (d) your violation of any law or third-party right; or (e) any dispute or interaction between you and a Partner.

13. Governing Law

These Terms are governed by the laws of the United States and, to the extent state law applies, by the laws of the state in which US Funding Direct is organized, without regard to conflict-of-laws principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

14. Dispute Resolution; Binding Arbitration; Class-Action Waiver

Please read this Section carefully. It affects your legal rights, including your right to file a lawsuit in court.

(a) Informal Resolution. Before filing any claim, you agree to first try to resolve the dispute informally by sending a written notice describing the dispute, including the relief you are seeking, to US Funding Direct by email to support@ssdiapprovalassist.com with the subject line "Dispute Notice." We will attempt to resolve the dispute within 30 days after receiving your notice. If we cannot resolve it within that period, either party may proceed to arbitration as described below.

(b) Binding Individual Arbitration. Any dispute, claim, or controversy arising out of or relating to these Terms or to the Site or Service (a "Dispute") that is not resolved informally will be resolved by final and binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules then in effect. The arbitration will be conducted by telephone or videoconference, or, at your election, in person in your county of residence. The arbitrator's award will be final and may be entered as a judgment in any court of competent jurisdiction. The Federal Arbitration Act (9 U.S.C. § 1 et seq.) governs the interpretation and enforcement of this Section.

(c) Class-Action Waiver. YOU AND WE EACH AGREE THAT WE MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate the claims of more than one party and may not preside over any form of class or representative proceeding. If this class-action waiver is found to be unenforceable, then the entirety of this Section 14 will be null and void as to the affected claim, but the remainder of these Terms will remain in effect.

(d) Mass Arbitration. If 25 or more similar arbitration demands are filed against us by or with the assistance of the same counsel or coordinated group of counsel within a 60-day period, the parties agree those demands will proceed under AAA's Mass Arbitration Supplementary Rules (or any successor rules), and the parties will work in good faith to select a process administrator to manage the cases.

(e) 30-Day Right to Opt Out. You may opt out of this agreement to arbitrate by sending a written notice to US Funding Direct by email to support@ssdiapprovalassist.com with the subject line "Arbitration Opt-Out" within 30 days after you first accept these Terms. Your notice must include your full name, the email address and phone number you used on the Site, and a clear statement that you wish to opt out of arbitration. Opting out will not affect any other provision of these Terms.

(f) Exceptions. Either party may bring an individual claim in small-claims court if it qualifies. Either party may also seek injunctive or other equitable relief in any court of competent jurisdiction to protect its intellectual property rights or confidential information.

(g) Survival. This Section 14 survives any termination of these Terms or your use of the Site.

15. Termination

We may suspend or terminate your access to the Site at any time, with or without notice or cause. The provisions of these Terms that by their nature should survive termination — including Sections 1, 7, 9, 10, 11, 12, 13, 14, and 16 — will survive.

16. General

(a) Entire Agreement. These Terms, together with the Privacy Policy and any other policies referenced in these Terms, constitute the entire agreement between you and us regarding the Site and Service and supersede all prior or contemporaneous agreements on that subject.

(b) Severability. If any provision of these Terms is found unenforceable, that provision will be modified to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

(c) No Waiver. Our failure to enforce any provision of these Terms will not be deemed a waiver of that provision or of our right to enforce it later.

(d) Assignment. You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign these Terms freely, including to any affiliate or successor in connection with a merger, acquisition, or sale of assets.

(e) No Agency. Nothing in these Terms creates any agency, partnership, joint venture, employment, or franchise relationship between you and us.

(f) Notices. We may provide notices to you by email, by posting on the Site, or by other reasonable means. You may provide notices to us by email at support@ssdiapprovalassist.com.

(g) Headings. Section headings are for convenience only and have no legal effect.

(h) Force Majeure. We will not be liable for any delay or failure in performance caused by events beyond our reasonable control, including acts of God, natural disasters, war, terrorism, labor disputes, internet or telecommunications failures, or governmental actions.
